These Terms of Service (“Terms”) govern your access to and use of remnantandcrown.com and any related services, products, content, or features operated by Simply Works Pro, doing business as Remnant & Crown (“Remnant & Crown,” “we,” “us,” or “our”).

By visiting our website, creating an account, placing an order, or otherwise using our services, you agree to these Terms, our Privacy Policy, Shipping Policy, and Return and Exchange Policy. If you do not agree, do not use the website or place an order.

Electronic agreements and records generally may not be denied legal effect solely because they are electronic under the federal E-SIGN Act. (US Code)

1. Eligibility

You must be at least the age of majority in your state or jurisdiction to use this website or make a purchase. If you permit a minor to use the website, you are responsible for the minor’s activity.

By placing an order, you represent that:

3. Products and Availability

We make reasonable efforts to display product descriptions, colors, photographs, dimensions, and other information accurately. Screen settings, lighting, fabric variations, manufacturing tolerances, and printing processes may cause minor differences between website images and delivered products.

Such reasonable variations do not necessarily constitute defects.

All products are subject to availability. We may:

Discontinue products or colorways.
Restrict sales by customer, account, address, region, or jurisdiction.
Correct product information.
Substitute updated packaging when the product itself is materially unchanged.
Refuse orders that appear fraudulent, abusive, or intended for unauthorized resale.

4. Pricing and Payment

Prices are displayed in U.S. dollars unless stated otherwise.

Applicable taxes, shipping charges, and other disclosed costs are calculated during checkout. You are responsible for all charges associated with your order.

We may correct pricing, product, or promotional errors before fulfillment. If an obvious pricing error affects your order, we may:

Contact you for approval of the corrected price, or
Cancel the affected item and return the amount paid for that item.

Payment authorization does not constitute acceptance of an order. An order is accepted when we confirm fulfillment or shipment.

You agree not to initiate an improper chargeback for an issue governed by a clearly disclosed store policy. This does not waive any lawful rights you may have through your card issuer.

5. Order Acceptance and Cancellation

We reserve the right to accept, reject, limit, hold, or cancel an order for reasons including:

Suspected fraud or unauthorized payment.
Pricing or inventory errors.
Incomplete or inaccurate customer information.
Product unavailability.
Violation of purchase limits.
Suspected unauthorized resale.
Prior return, payment, or account abuse.
Shipping restrictions.
Technical or system errors.

If we cancel a paid order before shipment, we will return the amount collected for the canceled merchandise through the original payment method, unless another lawful arrangement is agreed upon.

Orders enter processing quickly. Cancellation, address-change, size-change, or product-change requests are not guaranteed after an order is submitted.

6. Shipping and Delivery

Shipping estimates are estimates, not guaranteed delivery dates, unless expressly stated otherwise.

You are responsible for providing a complete and accurate delivery address. We are not responsible for delays, failed delivery, or additional costs caused by:

Incorrect or incomplete addresses.
Carrier delays.
Weather.
Natural disasters.
Customs processing.
Labor disruptions.
Security checks.
Events beyond our reasonable control.

Federal rules generally require online sellers to have a reasonable basis for advertised shipping times and, when no shipping time is stated, to ship within 30 days or seek the buyer’s agreement to a delay. (Federal Trade Commission)

Risk of loss and title pass as permitted by applicable law and the selected shipping arrangement. A package marked delivered by the carrier may require the customer to contact the carrier, local delivery office, household members, building management, or law enforcement before a replacement claim is considered.

We may require additional verification for orders involving:

High-value purchases.
Billing and shipping address mismatches.
Freight-forwarding addresses.
Repeated lost-package claims.
Unusual payment activity.

7. Returns, Exchanges, and Store Credit

Purchases are subject to our separately posted Return and Exchange Policy, which is incorporated into these Terms.

Unless otherwise required by law:

Eligible items may be returned within 30 calendar days of purchase.
Prior approval and a valid Return Merchandise Authorization number are required.
Items must be unworn, unwashed, unused, unaltered, and returned with original tags and packaging.
Approved returns are eligible for store credit or an exchange, not a cash refund.
Customers are responsible for return shipping.
Original shipping charges are nonrefundable.
Final-sale, personalized, customized, worn, washed, altered, or unauthorized returns are not eligible.
All returns remain subject to inspection.

8. Damaged, Defective, or Incorrect Orders

You must inspect your order promptly.

Claims for damaged, defective, missing, or incorrect items must be submitted within 5 calendar days of confirmed delivery, unless a longer period is required by law.

Your claim should include:

Order number.
Description of the issue.
Photographs of the item.
Photographs of the packaging and shipping label.
Any other information reasonably requested to evaluate the claim.

Do not wear, wash, alter, repair, discard, or return the product before receiving instructions.

After reviewing the claim, we may provide an appropriate remedy, which may include replacement, repair, store credit, refund, or another remedy required by law.

Normal wear, improper care, accidental damage, misuse, shrinkage caused by improper washing, or damage caused after delivery is not considered a manufacturing defect.

9. Promotions, Discounts, and Gift Cards

Promotions are subject to their stated terms and may be modified or withdrawn before purchase.

Unless expressly permitted:

Discounts cannot be combined.
Discounts cannot be applied retroactively.
Promotions have no cash value.
Promotional codes may be limited by item, customer, order, region, or date.
Free-shipping offers apply only to qualifying orders and destinations.
Gift cards cannot be exchanged for cash except where required by law.
Returned bundle items may be credited at their adjusted promotional value rather than full individual retail price.

We may cancel promotions or orders affected by abuse, unauthorized code sharing, system errors, or fraudulent activity.

10. Accounts

You are responsible for safeguarding your account credentials and all activity conducted through your account.

You agree to notify us promptly of suspected unauthorized access.

We may suspend, restrict, or close accounts associated with:

Fraud.
Chargeback abuse.
Return abuse.
Harassment.
Threats.
Automated scraping.
Unauthorized resale.
Repeated policy violations.

Closing an account does not eliminate payment obligations or liabilities incurred before closure.

11. Intellectual Property

All website content—including trademarks, logos, collection names, artwork, apparel designs, photographs, graphics, text, videos, product descriptions, layout, and branding—is owned by or licensed to Remnant & Crown and is protected by applicable intellectual-property laws.

This includes, where applicable:

Remnant & Crown branding.
Remnant, Warrior, Kingdom, Worship, Exodus, and related collection branding.
Wheat, crown, shield, eagle, and other collection symbols.
Original apparel artwork.
Photographs and promotional materials.
Taglines and branded copy.

You may not copy, reproduce, modify, manufacture, publish, distribute, sell, license, scrape, or create derivative works from our content without prior written authorization.

Purchasing a product does not transfer intellectual-property rights in the design.

12. Customer Submissions

If you submit a review, photograph, testimonial, comment, social-media tag, or other content, you represent that:

You own or control the necessary rights.
The submission is accurate and lawful.
It does not infringe another person’s rights.
It does not contain defamatory, deceptive, obscene, or malicious content.

Unless otherwise agreed, you grant Remnant & Crown a nonexclusive, worldwide, royalty-free license to display, reproduce, adapt, publish, and use submitted content for operating and promoting the business.

You may request that we stop future use of personally identifiable submitted content by contacting us, although removal from previously printed or completed materials may not always be possible.

13. Reviews and Communications

Reviews must reflect genuine experiences. We may decline or remove reviews containing:

Profanity or harassment.
Personal information.
Spam.
Fraudulent claims.
Unrelated content.
Intellectual-property violations.
Incentivized claims that are not properly disclosed.

Submitting a review does not guarantee publication.

Marketing emails and text messages, when offered, are governed by the consent language presented when you subscribe. Transactional messages relating to orders may still be sent when necessary to complete or service a purchase.

14. Third-Party Services

Our store may use services provided by Shopify, payment processors, shipping carriers, analytics providers, social platforms, email providers, and other third parties.

We do not control third-party websites or services and are not responsible for their:

To the fullest extent permitted by law, our total liability arising from a specific order will not exceed the amount you paid to Remnant & Crown for the product giving rise to the claim.

These limits do not apply where liability cannot lawfully be excluded or limited.

18. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Remnant & Crown and its owners, employees, affiliates, contractors, and service providers from claims, losses, damages, liabilities, and reasonable expenses arising from:

Fraudulent or unlawful activity.
Your infringement of another party’s rights.
Content you submit.
Unauthorized resale or misuse of our products or intellectual property.

This provision does not require indemnification for conduct for which indemnification cannot legally be required.

We may suspend performance, substitute reasonable fulfillment methods, or cancel affected orders and return amounts paid for unfulfilled merchandise.

20. Governing Law and Venue

These Terms are governed by the laws of the State of Georgia, without regard to conflict-of-law principles.

Except where applicable law requires otherwise, disputes arising from these Terms, the website, or purchases from Remnant & Crown shall be brought in the appropriate state or federal court located in [Cobb County, Georgia], and each party consents to that court’s jurisdiction.

Nothing in this section prevents either party from bringing an eligible claim in small-claims court.

21. Informal Dispute Resolution

The parties agree to allow at least 30 days to attempt a good-faith resolution before commencing litigation, unless immediate legal action is necessary or the waiting period is prohibited by law.

22. Termination

We may suspend or terminate your access to the website when we reasonably believe you have:

Engaged in fraud.
Abused returns or chargebacks.
Threatened staff or customers.
Misused intellectual property.
Attempted to interfere with the website.

Provisions relating to payment, ownership, intellectual property, disclaimers, liability, indemnification, disputes, and governing law survive termination.
